Healthcare Practice Group Wins Trial for Tampa General Hospital

Barbara J. Harvey v. Florida Health Sciences Center, Inc. d/b/a Tampa General Hospital

Edward J. Carbone, Managing Partner of the Tampa office of ROIG Lawyers and the Partner in Charge of the Firm's Healthcare Practice Group and Jacqueline R. A. Root, Medical Malpractice and Healthcare Attorney in the Tampa office of ROIG Lawyers, delivered a tremendous result for Tampa General Hospital after a two-day trial in the United States District Court for the Middle District of Florida.

The jury was presented with the plaintiff’s claims for unjust enrichment and Medicare Private Cause of Action. The plaintiff sought an award of $1.8 million dollars. However, after lengthy arguments about the law and the evidence that had been presented, the court agreed that Tampa General Hospital was entitled to judgment as a matter of law.

This is the seventh victory obtained by Ed and Jacqueline for TGH, by dismissal, summary judgment, or judgment at trial, in a four-year saga of litigation following voluntary binding arbitration proceedings to resolve a medical malpractice claim.
