The Impact of Transparency in Damages

This course discussed Fla. Stat. 768.0427 and 57.104 including examples of factoring companies, letters of protection, health coverage, Medicare and Florida Medicaid fees schedules with direct application to cases. We will evaluate the impact to bodily injury tort cases and the importance of properly valuing damages to trigger entitlement, or avoid Plaintiff’s entitlement, under a proposal for settlement. Additionally, we will discuss how to ensure admissibility of evidence of future and past medical expenses.
