How did Joseph Paxton win against BOTH the insured and the AOB company?
In a consolidated case at the MSJ hearing, both Plaintiff’s and the insurance carrier filed competing expert engineer affidavits. Mr. Paxton successfully argued that the Plaintiffs’ engineer’s affidavit was highly conclusory and failed to establish that the insured’s roof suffered wind damage. The Court agreed and judgement was entered in favor of our client!
